Terms of Service
Effective October 12, 2026
NOTICE: THESE TERMS ARE SUBJECT TO ARBITRATION PURSUANT TO THE SOUTH CAROLINA UNIFORM ARBITRATION ACT AND THE FEDERAL ARBITRATION ACT, AND CONTAIN A CLASS ACTION WAIVER. SEE THE "BINDING ARBITRATION" SECTION BELOW.
Agreement
By visiting this website, requesting or scheduling an appointment, or receiving services from Hardin Tech & Notary ("we", "us"), you accept and agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use this site or our services. They are governed by the laws of the State of South Carolina.
Scheduling and arrival windows
All services are provided by appointment only. Hardin Tech & Notary is a mobile business with no storefront or office location. Appointments are scheduled in a one-hour arrival window. For example, with a 4 to 5 PM window, your technician or notary may arrive at any time within that hour. We make every effort to keep to the window, and if we are running late, we will contact you. Delays are extremely rare, such as when a previous appointment runs over. We pride ourselves on punctuality and professionalism.
In the rare event that our technician or notary cannot make the appointment, or arrives more than 15 minutes after the end of your arrival window, you are entitled to a 10% reduction on your next service with us. This credit has no cash value, is non-transferable, and does not apply to the $5.00 notary fee. Arrival windows and this credit do not apply to delays or cancellations caused by inclement weather, natural disasters, or other events beyond our control. If that happens, we will contact you to reschedule.
Cancellations and no-shows
Please give at least 24 hours' notice to cancel or reschedule. The trip charge is due if you cancel with less than 24 hours' notice, are not home at the scheduled time, do not come to the door, or cannot be reached. For notary appointments, the applicable travel fee is due in the same situations. If you need to cancel because of severe weather, a natural disaster, or a similar emergency, no trip charge or travel fee applies as long as you reschedule your appointment. If we cancel, or cannot make an appointment for reasons on our side, you owe no trip charge, travel fee, or other charge for the service not performed.
Appointment environment
We value your time and your space, and we care about the safety of our technicians and notaries. For in-home appointments, you agree to provide a suitable place for the notary to set up and for documents to be signed, or for repair work to be completed, without distraction. It is your responsibility to ensure a safe and appropriate environment in which the client and our representative can work.
If your home is not a good fit for the appointment, we are happy to meet at a public place, such as a library, when the service allows. Conditions that may prevent us from working include unsanitary, hazardous, or heavily cluttered spaces, pest infestations, illegal drug use or visible drug paraphernalia, and intoxicated persons. If, in our representative's professional judgment, a suitable environment cannot be obtained or provided, the representative may cancel or end the appointment. The trip charge or travel fee remains due and is not refunded.
Professional conduct
Our representatives maintain a professional demeanor at all times, and we expect the same from our customers. Representatives are strictly forbidden from engaging in controversial conversations, and all interactions between customers and representatives must remain professional and polite.
If a customer becomes hostile or aggressive, or conduct departs from these standards, the representative may cancel or end the appointment at any time and leave without completing the work. In that case, the customer remains responsible for the trip charge, and it is not refunded.
Safety
Our technicians and notaries may refuse to begin or may end any appointment, in person or remote, if they feel unsafe or threatened. Examples include threats, harassment, intoxication, aggressive animals, or unsafe premises. The trip charge is not refunded when an appointment ends for this reason.
Offensive or explicit material
Our technicians do not browse your files, and will never go looking through your files, folders, or personal data. For these Terms, a public space means anything in plain view during service: open browser tabs, the main (top-level) folders on the machine, and files that are open on the machine in clear view.
If offensive or sexually explicit material is visible in a public space, the technician may refuse to continue and end the appointment at any time. This applies to in-person and remote service. When an appointment is ended for this reason, the trip fee is not refunded, and any deposit or charge for remote work is not refunded.
Mandatory reporting
Under South Carolina law (S.C. Code Ann. ยง 16-3-850), computer technicians are mandated reporters. As an in-home tech provider, Hardin Tech & Notary is legally obligated to report to law enforcement any suspected case of child abuse or neglect, and any sexually explicit images of minors (child sexual abuse material, or CSAM) viewed on a computer or device we are servicing. The report may include the identity of the owner or person in possession of the device. We do not search for such material, but we are required by law to report it if we see it. By using our tech services, you acknowledge this obligation.
Fraud
Any attempt to commit fraud, including presenting false identification or forged documents, will be refused and reported to the appropriate authorities.
Notary and signing services
Notarial acts are performed according to South Carolina law. You must appear in person and present acceptable identification, and the signer must be willing and aware of what they are signing. We may decline any notarial act that does not meet legal requirements. We are not attorneys and cannot give legal advice or prepare legal documents beyond what the law allows. Signing agent services cover the handling and signing of documents only; we do not explain or negotiate loan terms.
Notary limits
Signers must be present in person with acceptable identification, and we may refuse any notarial act that does not meet legal requirements. A notarization confirms the signer's identity and signature. It does not certify that a document's contents are accurate, legal, or enforceable. We are not responsible for errors or omissions in documents prepared by others, and we cannot give legal advice.
Data loss and release of liability
Services are provided in an effort to fix, upgrade, or otherwise repair the computer systems you ask us to service. Your system will not be intentionally harmed. Our goal is to fix your computer, not damage it.
Working on computer equipment can put stored data at risk. It is your responsibility to back up your data before service, and you confirm that you have done so. Hardin Tech & Notary, and its owner, employees, agents, and contractors, are not responsible for data loss, corruption, or inaccessibility that may occur as a result of a repair or other service.
Release and waiver. To the fullest extent permitted by South Carolina law, you release, waive, and discharge Hardin Tech & Notary and its owner, employees, agents, contractors, representatives, successors, and assigns from any and all claims, demands, damages, losses, costs, and liability of any kind arising out of or related to our services. This includes loss, corruption, or inaccessibility of data or files; software or hardware failure or damage; damage from existing problems such as viruses, misconfigured software, or failing hardware; loss of use or downtime; and accidental damage to your system. This release applies whether or not the claim is based on negligence. It does not release liability for gross negligence or willful misconduct to the extent the law does not allow that liability to be released.
30-day repair warranty
Tech service repairs carry a 30-day warranty on labor only. It covers only the same issue, or issues that come from the original complaint. It does not cover parts, new or unrelated problems, damage after the repair, or software and hardware failures that arise separately.
No other warranties
Except for the 30-day labor warranty described above, services are provided "as is" and without warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Third-party tools, parts, and services
Our services rely on third parties, including TeamViewer for remote support, Square and PayPal for payments, Google Forms for appointment requests, and outside vendors for parts you order. Those products and services are governed by their own terms and warranties, and we are not responsible for their outages, changes, or failures. All parts used in repairs are purchased by the customer directly from the supplier. Any warranty on parts, or lack of one, is determined by the supplier.
Payment
Quoted prices are for electronic payments. Payments by cash, Zelle, or Cash App receive a 3% discount. The notary fee is a flat $5.00 per notarial act and is excluded from markups, surcharges, and discounts. We also accept Venmo and all major credit and debit cards through Square, at the quoted price. Payment is due at the time of service unless agreed otherwise. Remote support prices vary with the issue and the time required, and any estimate is not a guarantee. Checks are accepted only on a case-by-case basis, at our sole discretion. If a check is accepted, two forms of ID are required, and a $35 return check fee will be charged for any check that is returned unpaid.
Refunds
We charge only for services provided, so we do not offer refunds. This includes Total Care subscription fees, which are not refunded or pro-rated. Issues covered by our 30-day labor warranty are corrected by repeating the work, not by refund. The only adjustments we make are those stated in these Terms, such as the late-arrival credit and the weather rescheduling provision.
Price match
Our price match applies only to verifiable advertised prices for like services, on both tech and notary services. We may ask for proof of the advertised price, such as a link, screenshot, or written quote, and the services must be of like scope and quality. The $5.00 notary fee is set by state law and is not subject to price matching.
Total Care subscription
Total Care is billed as a recurring subscription through PayPal. You authorize recurring charges to your PayPal account until you cancel. You may cancel at any time through your PayPal account or by contacting us. Cancellation takes effect at the end of the current billing period. Subscription fees are not refunded or pro-rated. Total Care covers remote support only. In-home repairs are not included, and members receive a discount on in-home repairs. The discount amount varies with the service, is set at our discretion, and is quoted before work begins. The discount applies only to our own service charges. Parts, third-party software, and other items purchased from outside suppliers are not discountable. Plan limits on devices and services apply as described on this site. Time or services beyond the plan are billed at the member rate we quote you.
Membership cancellation
Hardin Tech & Notary may cancel a membership, including a Total Care subscription, at our sole discretion for repeated offensive or explicit material, harassment of our technicians, abuse, a pattern of poor conduct, or similar behavior.
Limitation of liability
To the fullest extent permitted by law, the total liability of Hardin Tech & Notary, and its owner, employees, agents, and contractors, for any claim arising out of or related to our services is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost profits, lost business, or downtime, even if we were told they were possible. These limits apply regardless of the legal theory and survive the end of our service.
General terms
Indemnification. You agree to cover costs, claims, and losses that arise from your misuse of our services, your fraud, or your violation of these Terms. Events beyond our control. We are not responsible for delays or failures caused by weather, emergencies, outages, or other events outside our reasonable control. Severability. If any part of these Terms is found unenforceable, the rest remains in effect. Entire agreement. These Terms, together with any service order or signed service agreement, are the full agreement between you and Hardin Tech & Notary.
Governing law
These Terms, and any dispute arising from our services, are governed exclusively by the laws of the State of South Carolina, without regard to conflict-of-law rules. This applies no matter where you live or where a service is received, including remote services provided to customers in other states. You agree that our services are provided from, and the contract is made and performed in, South Carolina, and you waive any claim that the law of another state or county applies. The arbitration agreement below is governed by the Federal Arbitration Act. Any court proceeding permitted under these Terms will be brought exclusively in the courts located in Greenville County, South Carolina, and you consent to their jurisdiction and waive any objection to that venue.
Binding arbitration
Except as stated below, any dispute, claim, or controversy between you and Hardin Tech & Notary arising out of or relating to our services or these Terms will be resolved by binding arbitration, not in court. The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider, and held in Greenville County, South Carolina, or by remote means if the parties agree. The arbitrator's decision is final, and a court may enter judgment on it.
You and Hardin Tech & Notary each waive the right to a jury trial and the right to bring or take part in a class, collective, or representative action. Claims must be brought on an individual basis only. Either party may instead bring an eligible claim in small claims court. Nothing in this section limits our right or duty to report to law enforcement or other authorities as described in these Terms.
Changes to these terms
We may change these Terms at any time, with or without notice. The version posted on this site when you request an appointment or receive service applies. Changes apply going forward and do not affect any dispute that has already begun. Questions: [email protected].
